§ 10-408. Restrictions on the location of billiard rooms.

  • (a)

    A billiard room which either sells alcoholic beverages for consumption on the premises or engages in package sales of such beverages or allows alcoholic beverages to be consumed on the premises shall not be located:

    (1)

    Within 1,000 feet of the property line of a private residential dwelling;

    (2)

    Within 750 feet of the property line of any public library or branch thereof;

    (3)

    Within 1,000 feet from the property line of any church, shrine, chapel, mortuary or other place used exclusively for religious purposes;

    (4)

    Within 1,000 feet of the property line of any school or college campus;

    (5)

    Within 750 feet of a regular stop where a school bus for the transportation of school children in the public schools of the county shall board or discharge passengers;

    (6)

    Where the proposed location is 1½ miles or less from an existing location for which the city has issued a game room license; or

    (7)

    Within 750 feet of a location for which a license to sell beer or wine has been issued by the city, the county, or any other governmental jurisdiction.

    (b)

    The distance requirements set forth in subsection (a) of this section shall apply in any and all directions from the property lines of the proposed location of the game room, as measured in a straight line. Notwithstanding any provision of this section, nothing in this article shall be applied in such as manner as to prohibit the operation of a billiard room in a particular location if such billiard room is fully in operation in such location on the date the ordinance from which this article is derived became effective.
