§ 24-101. Definitions.

  • The following words as used in this article shall have the following meanings:

    Applicant means the charitable organization seeking a permit.

    Charitable organization means organizations which are qualified under Section 501(c) of the Internal Revenue Code of 1986, as amended; Georgia registered nonprofit corporations; churches; and public and private schools. Charitable organizations must also either be registered with the Secretary of State under O.C.G.A. § 43-17-5 or be exempt from such registration under O.C.G.A. § 43-17-9.

    Chief means chief of police of the city or his or her designee.

    Event means any charitable solicitation within the city.

    Event permit means a permit issued pursuant to this article to conduct an event.

    Permit means an event permit.

    Solicitation or charitable solicitation means the act of asking for employment, business or contributions on a public road, street, highway, right-of-way, sidewalk or other public property from the occupant of any vehicle or any pedestrian; provided, however, that "solicitation" or "charitable solicitation" shall not mean or refer to the act of asking for contributions under the following circumstances: (a) the person asking for contributions is doing so on behalf of, and with the express authorization of, a charitable organization, civic group or public entity that has obtained from the city a permit or other express approval or authorization to close and utilize a public road, street, highway, right-of-way, sidewalk or other public property for a special event, or on behalf of, and with the express authorization of, a charitable organization, civic group or public entity that has obtained permission and approval of another charitable organization, civic group or public entity that holds such a permit or other express approval or authorization, and (b) the person asking for contributions is doing so from the portion of the public road, street, highway, right-of-way, sidewalk or other public property that has been closed and is being utilized for such event; and further provided that "solicitation" or "charitable solicitation" shall not mean or refer to the act of asking for business under the following circumstances: (a) the person asking for business is doing so on behalf of, and with the express authorization of, a business that holds a valid and effective business license from the City of Hartwell. (b) the person asking for business is doing so from the sidewalk or other public property that is located adjacent to and in front of the location of such business, and (c) the person asking for business is not doing so from a public street, road, or right-of-way.

    Solicitor means any person who engages in solicitation.

    Travel lanes means the marked lanes on a road or highway, or the lanes of travel for vehicles, including turn lanes, access lanes, and acceleration or deceleration lanes.
